Terms & Conditions

NOTE: These Conditions of Business form a legally binding agreement (the “Agreement”) between Irv Graham Chinese Antique Valuations (the “Company”) and you (the “Client”). By choosing to have your item valued by Irv Graham Chinese Antique Valuations, you agree to the terms set out below.

By submitting photographs and related information of the item to be valued, the Client:

  • Accepts the Conditions of Business as set out here.
  • Grants the Company a worldwide, non-exclusive, perpetual, royalty-free license on all submitted material. The Company reserves the right to refuse to provide a valuation.

The Agreement consists of these Terms & Conditions. No other documentation or communication shall form part of the Agreement unless both parties agree in writing. The Agreement takes effect once the Company accepts to make a valuation and the Client has paid the Price, subject to the Company’s right to withdraw its services in accordance with these terms.

Under the Agreement, the Company provides a valuation service based on the photograph of an item submitted by the Client. This service includes an electronic estimate of the value of the item (high and low estimate), based on the Company’s opinion at the time the Valuation is given. The Valuation does not account for sale expenses, commissions, taxes, or other costs. Unless otherwise stated, the Valuation is based on a preliminary inspection of the photograph and without physical inspection, cleaning, restoration, detailed inspection, or further research.

The Company aims to provide the Valuation within two (2) working days after the Client submits their request, provided all relevant information and clear photographs are supplied. If this period is exceeded, the Company must write to the Client explaining the delay and extend the valuation period by an agreed timeframe. If the delay is due to the Client’s lack of information, no refund is entitled.

The Company does not guarantee the origin, provenance, attribution, condition, date, age, or authenticity of an item in the Valuation. The Company does not guarantee that the item will realize the estimated value upon sale. The Valuation remains the copyright of the Company and is prepared only for the Client. It is not to be used by any other person, disclosed to third parties (other than the Client’s professional advisors), or reproduced without the Company’s prior written consent. The Client indemnifies the Company and its affiliates against all liabilities and expenses resulting from any breach of this commitment by the Client.

The Valuation may not be used for official purposes such as legal proceedings, insurance, or other formal uses. It is provided as an estimate based on the information available at the time.

The Client shall pay the Price for the Valuation to the Company and warrants they are the owner or authorized by the owner to have the item valued. The Client warrants each item is free from third-party interests or claims and that all provided material is owned by them or they have the right to use it. The Client indemnifies the Company against any breach of this warranty.

The Client shall provide clear photos and full, accurate information about the object, including known authenticity issues, provenance, condition, previous sales history, and any other relevant details.

The Client acknowledges that the Valuation is a reasonable opinion and that opinions on value may differ. The value of an item can fluctuate due to market conditions and other factors. The preliminary nature of the valuation work may mean that identification, attribution, and value could change with further examination.

The Price is in accordance with the price list on the Company’s website at the time of submission and includes VAT. The Company reserves the right to revise prices and offer discounts at various times.

The Company is not liable for any deficiency in the Valuation due to external circumstances, incomplete information from the Client, or factors that cannot be identified from a reasonable inspection of the photographs and information received.

Nothing in these Terms & Conditions limits the Company’s liability for death or personal injury caused by negligence, fraud, misrepresentation of a fundamental matter, or any liability that cannot be excluded under applicable law.

If the Company breaches these Terms and Conditions, the Agreement shall be terminated immediately, and a refund of the Price paid for the Valuation shall be given, less any administration charges. The Client’s license to the Valuation will be revoked, and the Client must destroy the Valuation.

If the Client uses the Valuation for illegal purposes, the Agreement shall be terminated immediately, no refund will be given, and the Client must destroy the Valuation. The Client shall pay the Company for any liabilities, expenses, and costs arising from the Client’s unlawful conduct.

No person other than the parties to the Agreement shall have any rights under the Contracts (Rights of Third Parties) Act 1999 to enforce any term of the Agreement.

If any part of the Agreement is held to be unenforceable, that term shall be deemed not part of the Agreement, and the remaining portions shall remain in full force and effect.

The Agreement shall be construed in accordance with English law. The parties submit to the exclusive jurisdiction of the English courts in the event of disputes.
